Traffic Violations and Your Driving Record
The Bureau of Motor Vehicles (or BMV) will assign points to your driving record (depending on the type of infraction) if you have received a speeding ticket or have been charged with a traffic violation. However, some traffic violations can result in immediate suspension. If you have a traffic violation that has caused suspension of your driver's license, you may be required to go to the BMV in order to get your driver's license reinstated.

The Points System and License Suspension
Point values are assigned to each moving violation, so if you are convicted of a traffic violation, your driving record will be assessed certain points. One of the most common violations is speeding, and points are assigned according to how much you violate the posted speed limit. For violations that are 1-15 mph over the posted speed limit, 2 points are assigned. For violations that are 16-25 mph over the posted speed limit, 4 points are assigned. For individuals that drive 26+ mph over the posted speed limit, 6 points are assigned for those violations.

There are other common traffic violations that can cause points to be assigned to your driving record. For failure to use headlights, 2 points will be assigned to your driving record. For an improper U-turn, 4 points will be assigned to your record; for disregarding a stop/yield sign, 6 points are assigned; for driving while suspended, 8 points are assigned to your driving record.

If you are a driver that has accumulated 18 or more points in two years, you will need to attend a driving hearing at the Bureau of Motor Vehicles (BMV). If you are required to attend this hearing, a determination will be made by a BMV officer whether or not your driver's license will be suspended (30 days to one year). In addition, you may be required to attend a BMV approved Driver Safety Program (within a certain time limit). If you do not complete a BMV-ordered Driver Safety Program, your driving privilege will be suspended. Any driver who has been convicted of two or more moving traffic violations will be required to complete a BMV approved driver safety program.

Attending a Defensive Driving or Driver Safety Program
You may obtain more information on approved defensive driving programs on the BMV website if you are a driver who has been required to finish a Bureau of Motor Vehicle Driver Safety Program. A court judge may offer you the opportunity to take a defensive driving course in lieu of having your driver's license suspended. The Driver Safety Program can be taken in the classroom, at home, using a video or DVD, or through an online course. However, classroom instruction may be required if you have been ordered to attend a defensive driving course by a court. If the defensive driving course is successfully completed, a 4 point reduction will result on your driving record. You may repeat the course once every three years.

Benefits of a Clean Driving Record
A clean driving record is helpful in numerous ways. You can remove 4 points from your driver record when taking an online defensive driving course. If you are a teen driver, you will receive a warning letter from the Bureau of Motor Vehicles upon your first traffic violation. This letter will detail some potential penalties that you can incur (including driver's license suspension and permit cancellation) if you get future traffic violations.

A mandatory teen driver program that any teen driver under 17 years of age must complete is called the Graduated Driver's License Program (GDL). This mandatory program consists of 50 hours of supervised driving time, and at least 10 hours of instruction must be completed at night. Teen drivers also have the option to enroll in an approved defensive driving school, and many auto insurance companies offer a discount for certification of a completed defensive driving course.
